The present general terms and conditions (“General Terms”) as well as all policies and additional terms posted on the Platform, including the Privacy and Data Protection Policy ,payment and invoices policy Payment Method , Delivery Policy , Return and Exchange Policy, warranty policy [To be Announced], and [any other policy] set out the cumulative Terms and Conditions (“Legal Terms”) pursuant to which we offer you access to and use of our Platform and services we offer therein (“Services”).
By accessing, registering and/or continuing to use or access our Platform and/ or Services, you are agreeing to be bound by the Legal Terms with immediate effect. The Legal Terms are subject to change by us at any time and at our sole and absolute discretion. Your continued use of the Platform and/ or Services following any such change constitutes an express, unconditional, and final agreement to the Legal Terms as modified and in place at the time of use.
References in the General Terms (“you”, or similar) are references to you as an individual or legal entity, as the case may be.

Blink is an e-commerce platform. We reserve our rights to introduce new services/ products or to update or withdraw any of our existing Services / Products, at our sole and absolute discretion, without bearing any liability whatsoever towards you.

Eligibility & Registration Requirements
You are eligible to register as a customer/ buyer and benefit from the Services, if you meet the following eligibility criteria:
- You are above the legal age for purchasing products in your country of residence; and
- You are able to provide a Delivery address in the Kuwait for your order delivery purpose.
In order to register on the Platform, you will need to provide us with certain information. Failing to provide the required info may lead to not accepting your registration.
We reserve the right to decline any registration without further explanation. We reserve the right to undertake such checks as are necessary to verify your identity.
Your Obligations
When using or accessing the Platform and/ or the Services, you agree that you:
- are responsible to maintain the confidentiality of, and restricting access to and use of your account and password and accept responsibility for all activities that occur under your account and password;
- agree to immediately notify us of any unauthorized use of your password or account or any other breach of security;
- will provide true, accurate, current, and complete information about yourself and your use of the Services as required by us.
- will cooperate with our requests for additional information regarding your eligibility and usage of our Services.
Intellectual Property Rights
Without prejudice to any rights granted under the Legal Terms (including the General Terms), all content included on the Platform, including but not limited to text, graphics, logos, images, audio clips, digital downloads and software, as well as all trademarks, copyrights, patents, publicity, database, and/or other intellectual property rights (together, "Intellectual Property Rights") are our sole and exclusive property or the property of our licensors. We (or our licensors, as the case may be) retain all rights, title, and interest in and to the Platform and the Services provided, including but not limited to, all Intellectual Property Rights.
You hereby agree that you have no right to use any of our Intellectual Property Rights without our prior written consent and that all rights not expressly granted to you in the Legal Terms are reserved and retained by us and/or our licensors.
Warranties, Representations & Undertakings
You warrant, represent, and undertake that:
- You shall always fully comply with all applicable law’s statutes and regulations.
- You have full power and authority to enter the Legal Terms.
- The execution and performance of your obligations under the Legal Terms do not conflict with any laws, rules, or regulations to which you are subject to or with any other agreements to which you are a party or which you are bound by; and
- If you create or use an account on behalf of a legal entity, you are authorized to act on behalf of such entity and the legal entity will be bound to the Legal Terms.
All Services in the Platform are provided to you on an “as is” basis, without any representations or warranties whatsoever from our end. We disclaim all warranties, conditions, and representations of any kind, whether express, implied, or collateral, including, but not limited to, all conditions, representations or warranties of merchantability, of fitness for a particular or general purpose, of non-infringement, of compatibility or that the Services are secure or error free or will operate without interruption or will be provided in a timely or proper manner or at all.
Furthermore, whilst we attempt to be as accurate as possible, we do not warrant that product descriptions or other content of any Service or the products listed on the Platform are accurate, complete, reliable, current, or error-free. In addition, as a buyer/customer, you agree that we are not responsible for examining or warranting the listings or content provided by us or third parties through the Platform, and that you will not attempt to hold us liable for any inaccuracies or defects in any of the listings.
Liability & Indemnities
We shall not (nor our parent company, subsidiaries and affiliates, nor our and their directors, officers, agents, employees, suppliers, subcontractors or licensors) be liable, whether based on an action or claim in contract, tort, negligence, breach of statutory duty or otherwise arising out of or in relation to the Legal Terms, the Platform and/ or the Services for any loss of profits, loss of data or information, business interruption or other pecuniary loss or for any special, indirect, incidental or consequential damages.
In addition, to the extent permitted by applicable laws and regulations, we (including our parent company, subsidiaries, affiliates, and our and their directors, officers, agents, employees, suppliers, subcontractors, or licensors) are not liable, and you agree not to hold us responsible, for any damages or losses or costs or expenses or claims or demands resulting directly or indirectly from:
- the content or other information you provide when using the Platform and/ or Services.
- your use of or your inability to use our Platform and/ or Services.
- pricing, shipping, format, or other guidance provided by us.
- delays or disruptions in our platform and/ or Services.
- viruses or other malicious software got by accessing or linking to our platform and/ or Services.
- bugs, errors, or inaccuracies of any kind in our Platform and/ or Services.
- damage to your hardware device from the use of products sold on the Platform and/ or Services.
- the content, actions, or inactions of third parties using our platform and/ or Services.
- a suspension or other action was taken by us regarding your use of the Platform and/ or Services.
- the duration or manner in which your listings appear in search results; or
- your need to modify practices, content or behaviour or your loss of or inability to do business as a result of changes to the Legal Terms.
You agree to indemnify and hold us, our parent company, subsidiaries, and affiliates, and our and their directors, officers, agents, employees, suppliers, subcontractors, or licensors harmless from and against any losses, damages, and expenses (including legal fees and attorney’s fees) (“Claims”) arising out of or related to:
- any claims or demands or action or cause of action made by any third party due to or arising out of your use of the Platform and/ or Services.
- your violation of any of the provisions of the Legal Terms, including any of the warranties, representations, and undertakings.
- your violation of any applicable laws, including privacy and data protection or anti-spam laws; or
- the manner in which you use our Platform and/ or Services, including but not limited to, the content you post, the items you list, or your infringement of the Intellectual Property Rights of any third party or that the content of your listings is slanderous, defamatory, obscene or violates any other rights (including privacy rights) of any third party (including other Platform users).
Suspension, Termination & Cancellation
We may, at our sole discretion and without prejudice to any of our rights and remedies and with no liability to you, limit, suspend or permanently withdraw your access of our Platform, cancel Services offered, or any product(s) ordered for any reason including but not limited to the following:
- If we believe that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of the Legal Terms.
- If you use our Platform for any unlawful and fraudulent purposes or in connection with a criminal offence or abuse of our policy and rules.
- You are suspected of inventory abuse or placing a bulk order. The following shall (without limitation) constitute inventory abuse or placing a bulk order:
- Products ordered are not for self-consumption but for commercial resale.
- Multiple orders placed for same the product at the same address, depending on the product category.
- Invalid address given in order details.
- Any abuse or fraud used to place the order; or
- Any order placed using a technological glitch/loophole.
We reserve our right to take appropriate action if you are suspected of acting fraudulently or if you file invalid and/or false claims or provide false, incomplete, or misleading information.
Severance
If any provision of the Legal Terms (or part of any provision) is or becomes illegal, invalid, or unenforceable, the legality, validity, and enforceability of any other provision of the Legal Terms shall not be affected.
If any provision of the Legal Terms (or part of any provision) is or becomes illegal, invalid, or unenforceable but would be legal, valid, and enforceable if some part of it was deleted or modified, the provision or part-provision in question shall apply with such deletions or modifications as may be determined by us, to make the provision legal, valid, and enforceable.
Force Majeure
We shall not be liable or responsible, nor be deemed to have defaulted under or breached the Legal Terms, for any failure or delay in fulfilling or performing any obligation, when and to the extent such failure or delay is caused by or results from acts beyond our reasonable control, including, without limitation: (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether or not war is declared), terrorist threats or acts, riot or other civil unrest; (d) change of law; (e) actions, embargoes or blockades; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; (i) a pandemic; (j) shortage of adequate power or transportation facilities, and (k) other reason or cause reasonably beyond our control and without fault (including negligence) on our part (each, a “Force Majeure Event”). We shall endeavour to promptly give notice of the occurrence of any Force Majeure Event, the nature thereof and the extent to which we can’t perform our obligations, but we are not bound to provide such notice.
Should a Force Majeure Event continue for more than six (6) months, then we may terminate or suspend our obligations under the Legal Terms indefinitely upon thirty (30) days' written notice to you. A Force Majeure Event that affects us alone does not negate your agreement to the Legal Terms if you decide to use the Platform.
Language
The Legal Terms are provided in both Arabic and English.
Third Party Rights
Except as expressly provided for in the Legal Terms, a person who is not a party to them shall not have any rights or protections under the Legal Terms.
Governing Law
The Legal Terms and any dispute or claim arising out of, or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with, the laws of Kuwait.
Jurisdiction
We will endeavour to resolve any issues you may have with our Platform amicably and as soon as possible. Any disputes or claims arising out of or in connection with the Legal Terms (including these General Terms), including any non-contractual rights or obligations arising out of or in connection with the same shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre ("Rules”), which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Dubai International Financial Centre. The language to be used in the arbitration shall be English.
Defect or Damage to Your Product
Warranty: Our warranty policy helps you stay covered in case of defects in material, design, and workmanship after purchase of the product. On selected products and in instances where we are considered the seller, a twelve (12) months warranty will be provided for the eligible items purchased for all the buyers in Kuwait. In instances where products are bought through a seller that is not us, the terms of the respective seller’s warranty will apply. The warranty of the item begins from the product delivery date. Warranty obligations are limited to repair of defective product or replacement of the defective part, or replacement or refund according to paid/sold price of the product itself (such decision at the product seller’s discretion). Not all products are covered by the warranty, always check the product listing to know if it includes warranty benefits.
Authorized Service Centres. On selected products and in instances where we are considered the seller, warranty repairs will be carried out by authorized service centers. In instances where products are bought through a seller that is not us, the terms of the respective seller’s warranty will apply. Please refer to our warranty process for more details.
- Warranty Period: Repair or replacement under the terms of this warranty does not provide right to extension or renewal of the warranty period. Warranty terms are in accordance with your PR device manufacturer. For more details about specific terms of the warranty for your device, please visit the support page of your product.
- Warranty Not Applicable: The warranty does not apply in the following circumstances:
- If a repair has been attempted by any service center not authorized by the product seller; physical damage i.e. product presenting clear signs of damage like broken screens, heavy dents, bent products, that can prevent a product from functioning properly; liquid damage i.e. any situation involving the submersion or splashing of an electronic device in any liquid/or when water indicator (if any inside the device) changes color;
- if there has been use of non-original accessories with your purchased product;
- if the serial number is removed from the product;
- for maintenance and periodic checks of purchased products;
- for replacement of consumables;
- where there has been abuse or misuse of the product e.g. by not using it for its intended purpose or not in accordance with manufacturer’s instructions on usage and maintenance;
- where there has been damage, failure to use in accordance with the specific instructions of core outlined in product user manual or where charged by chargers other than those approved by manufacturer; and
- if any of the seals on the product are removed or show evidence of tampering.
